Rapid City Judge Says Loss Of Title Not Related To Lawsuit

RAPID CITY, S.D. (AP) — A 7th Circuit judge in Rapid City says he was stripped of his title of presiding judge because of a dispute with the chief justice of the state supreme court and not an ongoing lawsuit.

Chief Justice David Gilbertson issued an order this week removing Judge Jeff Davis as presiding judge of the 7th Circuit. The 67-year-old Davis had held the position since 2006.

Davis is a defendant in a federal lawsuit that accuses him and other state officials of violating the Indian Child Welfare Act in their handling of abuse and neglect cases involving Native American children.

Davis tells the Rapid City Journal ( ) that the change in presiding judge is the result of an “internal dispute” between him and Gilbertson over “space issues” in the Pennington County Courthouse.
