SD Death Row Inmate Rodney Berget Asks For Execution Delay

SIOUX FALLS, S.D. (AP) — A man sentenced to die for his role in killing a South Dakota prison guard has asked for a delay in his execution that’s scheduled for May.

KELO-TV reports ( ) Rodney Berget’s attorney, Jeff Larson, filed a motion for stay of execution on Tuesday. He says it should be delayed while they await a federal appeal.

A judge in November issued a warrant of execution that calls for Berget to die by lethal injection the week of May 3.

Berget was sentenced to death for the killing of penitentiary guard Ronald Johnson during an April 2011 escape attempt. Another inmate charged in Johnson’s death, Eric Robert, was executed in 2012.
