Aberdeen Woman Gets New Trial In Child Sexual Abuse Case

ABERDEEN, S.D. (AP) — A judge has ordered a new trial for an Aberdeen woman who had been convicted on three counts of sexual contact with a minor.

The American News reports ( ) that 23-year-old Santana Mosbrucker was convicted by a Brown County jury in 2012. The case involved two children who were 3 and 2 years old at the time.

Judge Richard Sommers ruled that a state Division of Criminal Investigation agent held onto a piece of evidence for too long and that the evidence could have helped Mosbrucker at trial.

Brown County prosecutor Chris White says the state attorney general’s office has started the process to appeal Sommers’ decision.
