AG: Deputy Justified In Using Lethal Force In Salem Shooting
SALEM, S.D. (AP) — Attorney General Marty Jackley says a sheriff’s deputy who shot a drunken bar patron in southeastern South Dakota last month was justified in using lethal force.
Jackley says the state Division of Criminal Investigation looked into whether McCook County sheriff’s deputy Randy Schwader was justified in shooting Cornelius Milk on July 19 in Salem.
Schwader shot the 38-year-old Milk after deputies responded to a call from the Brewery Bar about an unruly man.
Schawder told investigators he feared that Milk would run him over with his vehicle, so he fired into the vehicle’s hood. Schwader says he saw Milk reach for something in his car and believed Milk was going to shoot him.

Schwader then fired at milk. He fired 12 times in all, striking Milk seven times.
