State’s High Court Deciding On Issue Of Law Officer Records
SIOUX FALLS, S.D. (AP) — The South Dakota Supreme Court is considering whether criminal defendants should be able to see the disciplinary records of law enforcement officers who arrested them.
The Argus Leader reports ( ) that justices heard arguments this week in a case involving Minnehaha County Sheriff’s Office personnel records.
Emily Lou Smith was arrested during a Sept. 30, 2014, traffic stop. She’s charged with resisting arrest, simple assault against a law officer and driving under the influence.
Smith’s attorney sought personnel records for the arresting officer to see if any complaints had been filed against him for excessive force. A circuit court judge agreed to the request, but prosecutors are objecting.
