Soda Pop Robber Declared Incompetent To Stand Trial

HURON, S.D. (AP) — A Lane man accused of stealing soda pop from a Huron convenience store at gunpoint last June has been declared incompetent to stand trial.

Prosecutor Dan Nelson tells KOKK radio that a Sioux Falls psychiatrist who examined Martin Moeller determined that he suffered from several mental health disorders that were treatable.

Defense attorney Arron Plicher asked Judge Jon Erickson to declare Moeller not competent for trial. Erickson granted the request when Nelson did not object.

Erickson ordered Moeller to undergo treatment at a human services center in Yankton. Moeller will remain there until he is deemed competent to stand trial.

Moeller last September pleaded not guilty by reason of insanity to charges of first-degree robbery and commission of a felony with a firearm.
