Spearfish Residents Suing City Over Years Of Sewer Backups
SPEARFISH, S.D. (AP) — Thirteen Spearfish residents have sued the city over sewer backups.
The plaintiffs say they have suffered through a series of sewer backups stretching back to 2008, leading to stinky, flooded basements and lost possessions.
Jennifer and Adrian Netterberg are one couple suing. They say they have suffered $40,000 in damages to their home through the years.
Plaintiff’s attorney John Fitzgerald says the city is negligent because it isn’t maintaining adequate sewer lines.
City Attorney Tom Brady says the city is not necessarily liable for damages caused by an infrastructure problem. He declined further comment, citing the pending litigation.
The lawsuit seeks undisclosed damages. It’s scheduled for trial in July.
