State And Lawyer For Gay Couples Appeal Judge’s SD Ruling

SIOUX FALLS, S.D. (AP) — The attorney general and a lawyer representing six couples challenging the state’s ban on same-sex marriage have followed through and appealed a federal judge’s ruling.

South Dakota Public Broadcasting reports ( ) they’re asking for an expedited hearing on the case before the 8th U.S. Circuit Court of Appeals.

U.S. District Judge Karen Schreier declared the state’s gay marriage ban unconstitutional last month but put legal same-sex marriages on hold.

Appeals of that ruling have been filed by Attorney General Marty Jackley and Minneapolis attorney Josh Newville, who represents the South Dakotans trying to overturn the ban.

The lawsuit challenges a 1996 state law and a voter-approved 2006 constitutional amendment that bans gay marriage.
