Sioux Falls Landlord Denies Discriminating Against Tenant

SIOUX FALLS, S.D. (AP) — A Sioux Falls landlord accused of turning out a tenant because his wheelchair might damage carpet has denied the discrimination allegation.

Calvin Salem says in court documents that Daniel Loring was evicted in March 2014 because he violated his lease agreement by allowing a guest to stay at his apartment.

Loring has sued in federal court, seeking unspecified damages from Salem and the Alice B. Salem Family Trust. The lawsuit alleges that Salem’s actions violated Loring’s rights under the Fair Housing Act.

Salem denies telling Loring he wasn’t allowed back into his apartment with his wheelchair, which he was using because of a broken leg. Salem says he spoke with Loring about removing the carpet from his apartment.

A trial date hasn’t been set.
